Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Banqaplatform, website, mobile applications, and any related services (collectively, the "Service") provided by Codego Group("Codego", "we", "us", "our"). "Banqa" is a brand owned and operated by Codego Group.
By creating an account, accessing the Service, or using a Banqa card you ("User", "you", "your") agree to be bound by these Terms together with our Privacy Policy, Cookie Policy, AML & KYC Policy and Cardholder Agreement. If you do not accept these Terms you must not use the Service.
1. Eligibility
To use the Service you must:
- be at least 18 years old and have legal capacity to enter into binding contracts;
- not be a resident of any country subject to comprehensive sanctions or otherwise restricted by Codego's compliance program;
- not be on any sanctions, terrorist or watchlists (OFAC, UN, EU, HMT, others);
- provide accurate identity information when requested for KYC.
2. Account registration
You must register an account with a valid email address, a strong password and successfully complete email verification. You are responsible for safeguarding your credentials and for all activity that occurs under your account. Notify us immediately at [email protected]of any unauthorized access.
3. Self-custody wallet
When you complete sign-up the Service generates a non-custodial crypto wallet with a 24-word recovery phrase that is shown to you once.
4. KYC / KYB
To order a Banqa card, deposit beyond regulatory thresholds, or engage in higher-risk activities you must successfully complete identity verification (KYC) and, where applicable, business verification (KYB). Verification is performed by Codego and/or contracted compliance providers. We may request additional documentation at any time and may suspend or terminate accounts that fail to comply. 5. Cards
Banqa cards are Visa-branded payment cards issued by Codego's licensed card-issuing partner. Use of the card is also subject to the Cardholder Agreement, the Visa Operating Regulations and applicable law.
6. Acceptable use
You agree not to use the Service:
- for any illegal, fraudulent, abusive or infringing purpose;
- in connection with prohibited industries (gambling without license, adult content involving minors, narcotics, weapons, terrorism financing, etc.);
- to circumvent sanctions or any compliance, security or anti-fraud controls;
- to abuse, harass, threaten or impersonate any person;
- to introduce viruses or scrape the Service in violation of applicable terms.
7. Fees
Fees for funding, card transactions, FX conversion, ATM use and other services are disclosed in the in-app fee schedule and in the Cardholder Agreement. We may change fees with reasonable notice; continued use after notice means acceptance.
8. Risks & disclaimers
Crypto-assets are volatile and may lose value. Blockchain transactions are generally irreversible. You acknowledge the technical, financial and regulatory risks of holding and spending crypto-assets and that the Service is provided "as is" without warranties of any kind except as required by mandatory law.
9. Limitation of liability
To the maximum extent permitted by law, Codego is not liable for indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data, goodwill or crypto-assets, arising out of or in connection with the Service. Our aggregate liability for any claim shall not exceed the fees you have paid to us in the 12 months preceding the event giving rise to the claim.
10. Suspension & termination
We may suspend or terminate your account at any time, with or without notice, if we reasonably believe you have breached these Terms, applicable law, or that continued service poses risk to us, our partners, other users or you. You may close your account at any time by contacting [email protected].
11. Changes
We may update these Terms from time to time. Material changes will be notified by email or in-app. Continued use of the Service after the effective date means acceptance of the revised Terms.
12. Governing law & disputes
These Terms are governed by the laws of England and Waleswithout regard to conflict of law rules. Disputes shall be resolved in the competent courts of London, save for non-waivable consumer-protection rights you may have in your country of residence.
